Partner Program Privacy Policy

1. Who We Are
Motiv Technologies Inc. (“Motiv,” “we,” “us,” or “our”) operates the Motiv Partner Program. We are the data controller for the personal data collected in connection with the Program. For privacy inquiries, contact us at privacy@motivtech.ai.
2. What Data We Collect
We collect the following categories of personal data from Partner applicants and active Partners:
2.1 Application Data
Full name, email address, phone number, company name, company website, industry focus, estimated client network size, expected referral volume, reason for applying, and how you heard about the Program.
2.2 Identity & Compliance Data
During onboarding of approved Partners, we collect identity verification information and tax documentation (e.g., W-9 or equivalent) as required by applicable tax law and our financial compliance obligations.
2.3 Activity & Performance Data
Referral link usage, clicks, Referred Client signups attributed to your account, commission accruals, tier status, payout history, and login activity on the Partner dashboard.
2.4 Payment Data
Bank account or payment method details necessary to process Commission payouts. Payment processing is handled by Stripe Inc. We do not store full bank account numbers on our servers.
2.5 Communications
Records of emails, support tickets, and other communications between you and Motiv in connection with the Program.
2.6 Technical Data
IP address, browser type, device identifiers, and session data collected when you access the application form or Partner dashboard. This data is used for security, fraud detection, and program integrity monitoring.
3. How We Use Your Data
We use Partner data for the following purposes:
- →Program administration: Processing your application, onboarding, providing dashboard access, tracking referrals, calculating and paying Commissions.
- →Program integrity and fraud prevention: Cross-referencing Partner data against the Client registry to detect self-referral, abuse, or circumvention. Monitoring referral patterns for anomalies consistent with prohibited conduct under Section 5 of the Partner Terms.
- →Identity verification and compliance: Verifying your identity, conducting Know Your Partner checks where applicable, and meeting our tax reporting and anti-money-laundering obligations.
- →Communications: Sending approval/rejection notifications, Commission statements, policy updates, and Partner program communications.
- →Legal obligations: Complying with applicable laws, responding to lawful requests from regulators or law enforcement, and enforcing our Partner Terms.
- →Security: Protecting the Partner dashboard and Motiv systems from unauthorized access.
4. Legal Basis for Processing (GDPR)
Where GDPR applies, we rely on the following legal bases:
- Contract performance — Processing necessary to administer the Partner Agreement and pay Commissions.
- Legitimate interests — Fraud prevention, program integrity monitoring, and security, where these do not override your fundamental rights.
- Legal obligation — Tax reporting, identity verification, and compliance with applicable law.
- Consent — Where we ask for consent specifically (e.g., optional marketing communications).
5. Third Parties We Share Data With
We do not sell your personal data. We share Partner data only with:
Stripe Inc.
Payment processing for Commission payouts. Subject to Stripe's Privacy Policy.
Cloudflare Inc.
Application form bot protection (Turnstile) and infrastructure security. Limited technical data only.
Internal systems
Our CRM, analytics, and support platforms operated by Motiv staff under confidentiality obligations.
Legal and regulatory authorities
Where required by applicable law or valid legal process.
Professional advisors
Lawyers, accountants, and auditors bound by confidentiality obligations.
6. Data Retention
We retain Partner data as follows:
- Application data (rejected applicants): 12 months from rejection date, then deleted.
- Active Partner data: Retained for the duration of the Partner relationship.
- Post-termination: Account data, referral records, and Commission history are retained for 7 years to satisfy tax, audit, and legal dispute obligations, then deleted or anonymized.
- Fraud and abuse records: Where a Partner account was terminated for cause under Section 5 of the Partner Terms, records relevant to the violation may be retained indefinitely for program integrity purposes.
7. Your Privacy Rights
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: Request a copy of the personal data we hold about you.
- Rectification: Request correction of inaccurate or incomplete data.
- Erasure: Request deletion of your data, subject to our legal retention obligations.
- Restriction: Request that we limit processing of your data in certain circumstances.
- Portability: Receive your data in a structured, machine-readable format (GDPR/UK GDPR).
- Objection: Object to processing based on legitimate interests.
- Opt-out of sale (CCPA): We do not sell personal data. If this changes, we will provide opt-out mechanisms.
To exercise any of these rights, contact us at privacy@motivtech.ai. We will respond within 30 days. We may need to verify your identity before fulfilling a request.
Note: Certain rights may be limited where processing is required for legal compliance, contract performance, or fraud prevention (e.g., we cannot delete Commission records required for tax reporting).
8. Data Security
We implement appropriate technical and organizational measures to protect Partner data against unauthorized access, loss, or disclosure, including TLS encryption in transit, access controls, and regular security reviews. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
9. International Data Transfers
Motiv operates primarily in Canada and the United States. If you are located in the European Economic Area, United Kingdom, or other jurisdictions with data transfer restrictions, your data may be transferred to and processed in Canada or the US. Where required, we rely on Standard Contractual Clauses or equivalent safeguards for such transfers.
10. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated to active Partners by email. Continued participation in the Program after the effective date of an update constitutes acceptance of the revised Policy.
